PREAMBLE

These General Terms and Conditions of Sale (hereinafter “GTC”) define the terms and conditions under which CERBERA Marie-Pierre offers the marketing of leisure and entertainment activities. These T&Cs apply, without restriction or reservation, to all sales concluded by CERBERA Marie-Pierre. (" seller ")

Consequently, any purchase by the buyer implies his full acceptance and adherence to these T&Cs which take precedence over any other document, except for special conditions expressly agreed to in writing by CERBERA Marie-Pierre.

The buyer acknowledges having read the GCS prior to his purchase.

These T&Cs come into force from February 14, 2022.

CERBERA Marie-Pierre reserves the right to modify these T&Cs at any time by updating them on its website https://www.corsenatureevasion.com/

In the event of modification of the T&Cs, the applicable T&Cs are those in force on the date of purchase.

The invalidity of a clause of these T&Cs does not entail the nullity of all of the T&Cs. The temporary or permanent non-application of one or more clauses of the GCS by the seller does not constitute a waiver on his part of the other clauses of the GCS which continue to produce their effects.

CERBERA Marie-Pierre cannot be held responsible for the illicit practices of its customers contrary to Book 4 of Title IV of the Commercial Code.

Any purchase of an activity offered on https://www.corsenatureevasion.com/ assumes the reading and acceptance of these GCS, without this acceptance being conditioned by a handwritten signature of the buyer.

PROOF

CERBERA Marie-Pierre reserves the right, following any purchase made on its website, to ask the buyer for any supporting documents in order to be able to validate their order.

In this case, the buyer will receive an e-mail informing him that his order is subject to verification and will then be asked to provide the supporting documents necessary for validation.

The absence of a response from the buyer to a request of this type within 2 days of the request made by CERBERA Marie-Pierre will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint.

PRICE

CERBERA Marie-Pierre reserves the right to modify its prices at any time, while guaranteeing the purchaser the application of the price in force on the day of the order.

Our activities are subject to VAT, i.e. 20%.

Consequently, the documents that may be issued to the attention of the buyer on the occasion of the delivery of the aforementioned products must include the invoiced VAT.

REGULATION

Payment for purchases is made as follows:

By Bank Card (Carte Bleue, Visa Card, Eurocard / Mastercard).

In case of purchase of the product, the customer indicates directly in the areas provided for this purpose: the card number, its validity date as well as its control code located on the back of the card.

The invoice will be sent to the email address indicated during the ordering process, at the buyer's expense to print it.

The responsibility of CERBERA Marie-Pierre can therefore in no way be held liable for any reason whatsoever when the delay is attributable to the buyer, that is to say in the event of an error in entering information on the part of of the buyer, when placing the order.

CANCELLATION / POSTPONEMENT

In accordance with the provisions of article L 121-21-8 3° and 12 of the Consumer Code, leisure activities are not subject to a right of withdrawal.

No cancellation or postponement of reservation will be accepted without the direct agreement of CERBERA Marie-Pierre.

The validation of the reservation will be taken into account upon receipt of the deposit; this can be issued remotely, by bank imprint, or on site according to the means of payment accepted by CERBERA Marie-Pierre. 

The customer acknowledges having read the information and characteristics of the service he has chosen according to his expectations. His choice takes into account the restrictions relating to the practice of Jet Ski, and the physical condition of the participant(s).

If the client should cancel his reservation:

More than 24 hours from the start of the service: the amount of the deposit recorded during your reservation will be refunded. 

Less than 24 hours from the start of the service: the amount of the deposit recorded during your reservation will not be refunded.

During the service: any voluntary interruption on your part does not entitle you to any reimbursement, as well as an exclusion decided by the instructor, for irresponsible behavior or non-compliance with safety instructions.

If we had to cancel a departure for reasons beyond our control, we would then offer you various replacement or postponement solutions, in agreement with the customer. Insofar as the activity is closely linked to weather conditions, and more particularly: to the wind; the instructor reserves the right to decide until the very last moment to cancel the hike. You will then be offered an alternative solution or a postponement. This decision takes into account meteorological factors that influence the comfort of the ride, such as wind or rain (cloud cover does not in any way affect the comfort or safety of the jet skier).

The Services do not include transportation to the selected meeting place.

​

EXCHANGE

The exchange is reserved for activities that have not been previously used. In no case can it be a refund.

He may also obtain a product at a higher price, subject to payment of the difference between the value of the exchanged product and the value of the new product requested.

The buyer or beneficiary must, if this step has not already been completed, contact the nautical base by telephone on 06 17 19 01 21 or by email mp.cerbera@wanadoo.fr in order to inform the company.

As part of an exchange, the exchanged product will be valid for 12 months from the date of purchase of the exchanged product.

NON-USE OF THE SERVICE

​

In the event of non-use, loss or destruction of the order and after the period of 12 months after the date of purchase, the beneficiary cannot claim any reimbursement.

CERBERA Marie-Pierre reserves the right not to follow up on complaints from a buyer and/or beneficiary who has acquired its product outside the traditional distribution network and in particular directly from an individual.

CONTRAINDICATION

Some activities are reserved for people over 16 years old. 

Caution activities are contraindicated to pregnant women and people who have undergone recent surgeries. It is strongly advised to inquire at 06 17 19 01 21 or by email: mp.cerbera@wanadoo.fr before your purchases.

Some services are only accessible under certain conditions of health, age, weight or skill. These conditions are indicated on the site https://www.corsenatureevasion.com/

The beneficiary undertakes to read these restrictions carefully.

CERBERA Marie-Pierre reserves the right to refuse the service requested if the beneficiary of the product does not meet the required conditions.

Some services are only accessible under certain conditions (physical, meteorological, technical or other).

It is advisable to book as early as possible in order to benefit from a wide range of dates.

CERBERA Marie-Pierre cannot be held responsible for any unavailability on the chosen date.

It is also advisable to carefully check any restrictions imposed for certain activities, in particular for Jet Ski excursions (days and times, etc.).

After receiving the order of activities in electronic version by e-mail, it is recommended that the buyer check the nature of the electronic order and formulate any reservations in the event of an error.

COLLECTION OF DATA

The collection of personal data, their use for order processing and the creation of customer files is subject to the consent of the person concerned.

In accordance with the Data Protection Act of January 6, 1978, the buyer / Beneficiary has a right of individual access, withdrawal, rectification and deletion of his personal data.

The Purchaser / Beneficiary may exercise this right by writing to CERBERA Marie-Pierre, Vaccil del Monte, Muratello 20137 Porto-Vecchio, indicating his surname, first name and address as well as the subject of the request.
